Create Your Own Adventure Contest: Terms & Conditions

General contest rules apply. The contest is run by Gap Adventures, Inc. (here and after referred to as “Gap Adventures.”) The contest runs from Feb 1, 2010 to March 31, 2010. Voting for submissions runs from February 1, 2010 to March 31, 2010. Judging Panel selects Top 20 finalists from April 1 to 7, 2010. User Voting for the final Top 20 will end by April 25, 2010 - this constitutes 50% of the final vote. Final voting by judges closes May 10, 2010 - this constitutes the remaining 50% of the final vote. Random Draw entries: Accepted for duration of the contest from February 1, 2010 to April 25, 2010. Winners will be notified by e-mail and announced on our website no later than May 25, 2010. Once a winner has been notified by e-mail of their win, they will have 2 weeks from receipt of e-mail to contact the Gap Adventures' sales team who will require all of their contact details and review the procedures for claiming a prize.

General Contest Rules

Top 20 Finalists are decided on by popular vote and judging panel criteria. Grand Prize winner will be chosen by both consumer voting (50%) and a panel of selected judges (50%). The Judging criteria is set by Gap Adventures and in its sole or absolute discretion will be based on originality & creativity, sustainability, life changing experiences and is not subject to appeal.

Grand Prize Conditions: The Grand Prize winner acknowledges that Gap Adventures has the right to create, develop, substitute and modify the concept of the winning entry based on logistics, operational requirements and safety requirements. The grand prize winner & two (2) guests all must depart from the same airport. It is the responsibly of the winner & guests to possess valid travel documents (including passports and visas) and purchase travel insurance with a minimum medical coverage of $200,000 USD for the duration of the tour.

Mystery Tour Conditions: Gap Adventures will reserve placement for up to five (5) winners on the grand prize departure tour. Dates to be determined by Gap Adventures, if Mystery Prize winners are unable to make this departure they will receive a $1,500USD Gap Adventures travel voucher in lieu. It is the responsibility of the winners to possess valid travel documents (including passports and visas) and purchase travel insurance with a minimum medical coverage of $200,000 USD for the duration of the tour.

All prizes are non-transferable, non-exchangeable or non-redeemable for cash and substitutions will not be permitted.  Travel must be completed within 1 year of contest end date.   Prizes do not include insurance or other third party services. All expenses shall be the responsibility of the prize winners. The prizes do not include items of personal nature, incidentals, phone calls, meals not included in the itinerary, vaccinations recommended for the region, or international airport taxes. Winners are responsible for obtaining their own travel visas. Winners will be notified by email and announced on our website no later than May 25th, 2010 after the end date of the contest. It is the responsibility of the winner to contact the Gap Adventures reservations department within two (2) weeks of receipt of winning email notification. Failure to do so will may result in forfeiting the prize, and an alternate winner being chosen.

By submitting entries for Create Your Own Adventure contest you will give Gap Adventures the legal right to use, modify and publish your submitted materials in any way it seems fit to include but not be limited to use in future brochures, websites, newsletters, social media and other campaigns without compensation.  Some entries will be selected and acknowledged on the Gap Adventures website and social media sites, in addition to the winning entries.

Entrants acknowledge that all entries must be their own original content. Participants must be 18 years of age or older including the Grand Prize Winner, his or her 2 guests and the 5 Mystery Prize Winners.

Participants acknowledge these contest rules are to be interpreted in accordance with the laws of the province of Ontario, Canada. By entering the contest and agreeing to our terms and conditions, the winners confirm their eligibility and compliance with the contest rules and release Gap Adventures, its partners and affiliates and their respective advertising and promotional agencies from all liability caused by, or resulting from, the acceptance or use of the contest prize. Gap Adventures reserves the right to substitute tours based on operational resources, feasibility and blackout dates may apply.

This contest is open to all participants, except employees of Gap Adventures, and any related, associated or connected company, its partners and affiliates and their respective advertising and promotional agencies. Residents of countries or provinces where they are prohibited or restricted in entering online contests are also prohibited from entering.

Gap Adventures, and any related, associated or connect company, its partners, sponsors, affiliates and their respective advertising and promotional agencies each assume no responsibility for situations such as but not limited to lost, stolen, delayed, damaged, or misdirected entries, or for any failure of the website or voting process during this contest, for any problems or technical malfunction of any telephone network or lines, computer online systems, services, access providers, computer equipment, software, failure of any e-mail or entry to be received by Gap Adventures on account of technical problems or traffic congestion on the internet or the website or any combination thereof including any injury or damage to any entrants, or any other persons computer, related to or resulting from playing or downloading any material in the promotion.

Gap Adventures will conduct periodic reviews of online votes to verify their validity. Unethical voting practices can and may result in certain IP addresses and participants being banned, with voting corrections taking place. Any attempt to deliberately damage the website or to undermine the legitimate operation of this promotion is a violation of the Criminal and Civil laws, and should such an attempt be made Gap Adventures reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Gap Adventures reserves the right to change the terms of this contest, or terminate it at any time, without prior notice and without any compensation, reimbursement or restitution.

All entries become the property of Gap Adventures and none will be returned. No correspondence will be entered into except with the selected entrants who will be notified by email and announced in our e-newsletter. Entrants, by entering this contest, agree to abide by these contest rules. Contest winners must consent to the use of their name and photograph, without compensation, in any publicity carried out by Gap Adventures. No future royalties will be given to the Contest winners if the 20th Anniversary tour becomes operational.

Entrants agree that the personal information collected for purposes of this contest can be collected, used and disclosed by Gap Adventures in accordance with its privacy policy, which is available on its web site.

Acceptance of Risk

The Client acknowledges that the nature of the tour is adventurous and may involve a significant amount of personal risk. The Client hereby assumes all such risk and does hereby release Gap Adventures from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks. Prior to tour commencement, the Client may be asked to sign a participation form, with the following wording:

“I understand traveling with Gap Adventures may involve risks (and rewards) above and beyond those encountered on a more conventional holiday, and that I am undertaking an adventure trip with inherent dangers. I understand I am traveling to geographical areas where, amongst other things, the standard of accommodation, transport, safety, hygiene, cleanliness, medical facilities, telecommunications and infrastructure development may not be of the standard I am used to at home or would find on conventional holiday. I have read and understood the Gap Adventures dossier for this trip I am undertaking and have provided details of any preexisting medical conditions I may have to Gap Adventures representatives. I accept these risks and obligations and I fully assume the risks of travel.

Optional Activities
I understand during my trip there may be opportunities to undertake activities, which do not form part of the itinerary. I understand Gap Adventures makes no representations about the safety or quality of the activity, or the standard of the independent operator running it. I also understand Gap Adventures is in no way responsible for my safety should I elect to enter into such optional activities. With full knowledge of the above, I may still elect to partake in the activity, and if I do so, I assume full responsibility for any risks involved, and the waiver and release of the Releasees set out in the foregoing paragraph shall apply to such optional activities.”
